1. Preamble and scope

These House Rules apply to the entire premises of Arena Nova BetriebsgmbH at Rudolf-Diesel-Straße 30, 2700 Wiener Neustadt. They include, in particular, all halls, foyers, adjoining rooms, traffic areas, outdoor areas, parking lots, access roads, delivery areas, green spaces, and all other areas belonging to the venue.

These House Rules apply to visitors, organizers, exhibitors, participants, service providers, suppliers, media representatives, and all other persons who enter or use the premises.

Events are subject to the applicable legal provisions, in particular the Lower Austrian Events Act (NÖ Veranstaltungsgesetz), the Lower Austrian Youth Act (NÖ Jugendgesetz), the relevant official permits, conditions and decisions, as well as the applicable safety, building, fire safety, trade, labor, youth protection and data protection regulations as amended from time to time.

These House Rules supplement contractual agreements, event terms and conditions, technical guidelines, safety concepts, fire safety regulations and official requirements. In the event of stricter legal, official or event-specific requirements, these shall take precedence.

2. Access and admission tickets

Access to events is permitted only with a valid admission ticket, accreditation, authorization pass or other access authorization recognized by Arena Nova BetriebsgmbH or the respective organizer.

Access authorizations are valid only for the event, time period and areas for which they were issued. Entering cordoned-off areas, areas not open to the public, or areas reserved for certain persons only is prohibited.

Admission tickets and other access authorizations must be kept until leaving the event premises and presented to control, security, stewarding or supervisory staff upon request.

Tampered, forged, invalid or improperly used access authorizations may be confiscated and declared invalid. In the event of a justified refusal of entry or justified removal for good cause, there is no entitlement to a refund of the admission price, insofar as legally permissible. Further legal steps remain reserved.

3. House rules, checks and instructions

The right to enforce the house rules is exercised by Arena Nova BetriebsgmbH, the respective organizer, and persons appointed by them, in particular control, security, stewarding and supervisory staff.

Instructions from control, security, stewarding and supervisory staff as well as official bodies must be followed insofar as they serve safety, order, compliance with official requirements, the running of the event, or the enforcement of the house rules.

Arena Nova BetriebsgmbH, the respective organizer and appointed security or stewarding staff are entitled, within the scope of the house rules and legal requirements, to carry out visual checks and bag checks. If a check is refused or there is an objective reason to assume a risk, entry may be refused or the person concerned may be removed from the premises.

Persons who are visibly intoxicated, under the influence of intoxicating substances, show aggressive behavior, harass others, endanger security interests or significantly disrupt the event operation may be refused entry or prohibited from remaining on the premises.

4. Conduct on the premises

All persons must behave in such a way that safety, order and the smooth running of the event are ensured. Visitors must not disrupt events, harass, endanger or discriminate against others, or damage any facilities, installations or objects.

Escape routes, emergency exits, traffic routes, fire brigade access routes, rescue routes, exits, stairs, doors, passageways and safety-related facilities must be kept clear at all times and must not be blocked, obstructed, altered or misused.

Climbing on railings, barriers, technical installations, grandstand structures, roofs, fences, stages, decorations or other facilities not intended for this purpose is prohibited.

Safety equipment, fire alarms, fire extinguishers, lighting systems, signage, barriers and technical installations may be operated, modified or removed only by authorized persons.

Rooms, areas and installations must be kept clean. Waste must be disposed of in the designated containers. Contamination, damage or sources of danger must be reported to staff immediately.

5. Children and young people

For children and young people, the provisions of the Lower Austrian Youth Act (NÖ Jugendgesetz) as amended from time to time apply, as well as any official, event-specific or safety-related age restrictions.

For safety and organizational reasons, persons under 14 years of age may be required to be accompanied by an adult supervisor from 8:00 PM.

Children under 3 years of age may be refused entry for safety, noise, capacity or event-protection reasons, unless a different rule has been announced for the specific event.

Legal guardians and supervisors must ensure that the children and young people accompanying them comply with these House Rules and do not endanger themselves or others.

6. Prohibited items and substances

Carrying items or substances that are suitable for endangering people, damaging property, disrupting the event operation or violating official requirements is prohibited.

Prohibited in particular are weapons and weapon-like objects, dangerous tools, throwing objects, pyrotechnic items, fireworks, smoke devices, flares, sparklers, highly flammable, explosive, corrosive, staining, toxic or health-endangering substances, glass containers, cans, bulky hard packaging, pressurized containers, gas spray cans, and other dangerous containers.

Also prohibited are laser pointers, mechanically or electrically operated noise instruments, megaphones, whistles, air horns, drones, remote-controlled devices, unauthorized radios, large or bulky items, ladders, stools, folding chairs, boxes, large bags, backpacks, suitcases, Camelbaks and comparable items, unless their use has been expressly permitted.

Bringing bicycles, skateboards, inline skates, scooters, e-scooters, Segways and similar means of transport into event areas is prohibited unless they are expressly permitted or required for medical reasons.

Also prohibited are unlawful, discriminatory, racist, xenophobic, National Socialist, sexist, violence-glorifying, extremist or other security-endangering materials, symbols, slogans or actions.

In case of doubt, the responsible security, stewarding or supervisory staff will decide on the admissibility of an item based on objective safety and event interests. Prohibited items may lead to refusal of entry or removal from the premises.

7. Smoking, fire, pyrotechnics, alcohol and intoxicants

Smoking and the use of e-cigarettes, tobacco heaters or comparable products is permitted only in expressly designated areas, provided that legal or event-specific smoking bans do not conflict with this.

Open flames, candles, torches, pyrotechnic items, special effects devices, smoke or fog machines and comparable equipment may be used only with prior consent of Arena Nova BetriebsgmbH and, where required, with official approval.

Bringing, consuming or passing on illegal intoxicants is prohibited. Alcoholic beverages may be consumed only within the framework of legal provisions, official requirements and event-specific rules.

Persons who, under the influence of alcohol or intoxicants, endanger safety, order or other persons may be excluded from entry or removed from the premises.

8. Parking, traffic and outdoor areas

Vehicles may be parked only in the designated and marked areas. The provisions of the 1960 Road Traffic Regulations (Straßenverkehrsordnung 1960) as well as local signage and traffic routing must be observed.

Fire brigade zones, rescue routes, access roads, exits, escape routes, sidewalks, delivery areas and other areas that must be kept clear must be kept clear at all times.

Illegally parked vehicles may be removed at the owner’s expense and risk, insofar as legally permissible and necessary to avert danger, maintain operations or remove an obstruction.

Green areas may be entered or used only if they are expressly open to the public. Any soiling or damage to outdoor areas, green spaces, parking lots and traffic areas is prohibited.

9. Cloakroom, bags and personal belongings

Jackets, umbrellas, large bags and other bulky items may, for safety, capacity or event-related reasons, be excluded from being taken into event areas and assigned to a cloakroom or storage point.

Use of a cloakroom or storage point is subject to the conditions and fees posted or announced in each case. Valuables should not be left unattended.

Medically necessary aids, mobility aids and assistance devices are permitted provided there is no specific security risk.

Arena Nova BetriebsgmbH is liable for items brought in only in accordance with statutory provisions and any custody expressly assumed.

10. Accessibility, assistance and animals

Arena Nova BetriebsgmbH strives to ensure safe and as barrier-free access to events as possible. Visitors who need support are asked to contact staff if required.

Assistance dogs within the meaning of the applicable legal provisions are permitted. Other animals may be brought only with prior consent of Arena Nova BetriebsgmbH or the respective organizer, unless different event-specific rules apply.

Mobility aids, wheelchairs, walking aids and medically necessary assistance devices are permitted. For safety reasons, suitable places or routes may be assigned.

11. Changing rooms, cloakrooms for participants and non-public areas

Changing rooms, sanitary areas, performer, team, technical, storage, backstage, demonstration, training and other non-public areas may be entered only by authorized persons.

Changing and sanitary areas must be used in accordance with their signage and organizational allocation. The privacy of all users must be respected. Entry by unauthorized persons is prohibited.

Excluded are necessary entries by supervisory, cleaning, security, medical, support or technical personnel, as well as other organizationally necessary cases.

Persons must leave cloakrooms and adjacent traffic areas in appropriate clothing. Storing highly flammable, explosive, corrosive, toxic or other hazardous substances in cloakrooms and changing rooms is prohibited.

12. Sports, training and demonstration areas

Entering sports, training, combat, demonstration and stage areas is permitted only after clearance and only for authorized persons.

Use of such areas is subject to the respective usage, safety and event rules. Users accept sport- and event-typical risks at their own responsibility. Statutory liabilities of Arena Nova BetriebsgmbH, the organizer or other responsible parties remain unaffected.

Sports areas may be entered only with suitable footwear and suitable equipment, unless a different rule has been announced.

13. Organizers, exhibitors, service providers and suppliers

Organizers, exhibitors, service providers, suppliers and other contractual partners are obliged to comply with all legal, official, contractual, technical and safety-related requirements applicable to their event, activity or use.

In particular, they must ensure the safety of visitors, participants, employees and third parties, submit required permits, notifications, evidence and documents in good time, and comply with instructions from Arena Nova BetriebsgmbH and the competent authorities.

Decorations, exhibition stands, floor coverings, curtains, technical installations, temporary structures, advertising materials and other structures may be brought in, erected and used only in compliance with the applicable fire safety, building, event and safety requirements.

Any transfer, subletting or other passing on of usage rights to third parties is permitted only with prior written consent of Arena Nova BetriebsgmbH.

14. Sales, advertising, collections and commercial activities

Commercial activities, the sale or distribution of goods, admission tickets, advertising material, printed matter, donation appeals or other materials are permitted on the premises only with prior written consent of Arena Nova BetriebsgmbH or the event management.

This applies in particular to ticket resale, promotion, flyer distribution, product sales, fundraising advertising, surveys, party-political advertising and comparable activities.

Content or actions that violate legal provisions, are discriminatory, racist, National Socialist, violence-glorifying, extremist or security-endangering, or that disrupt the event operation are not permitted.

15. Photo, film, video and audio recordings by visitors

Private photo and video recordings may be permitted provided that no third-party rights, copyright or related rights, data protection rights, security interests or event-specific requirements are violated.

Commercial, journalistic or other professional photo, film, video and audio recordings as well as live streams require prior consent of Arena Nova BetriebsgmbH or the event management.

The use of flash, tripods, drones, additional lighting, audio recording devices or other professional equipment may be prohibited for safety, rights-related or event-related reasons.

Stricter recording bans may apply for individual events. These will, where possible, be announced on site, on admission tickets, online or by notice.

16. Photo, film and video recordings by Arena Nova or the organizer

At events, photo, film and video recordings may be made by Arena Nova BetriebsgmbH, the respective organizer or persons appointed by them. These may be processed and published in particular for documentation of the event, public relations, press reporting and communication via websites, social media, print media and other communication channels.

Processing is carried out exclusively in accordance with the applicable data protection regulations. Further information, in particular on controllers, purposes, legal bases, recipients, storage periods and data subject rights, can be found in the applicable data protection notice on photo and video recordings, which is provided at the event location and/or online.

Where individual persons are specifically the focus of the recording, separate consent will be obtained where required, or another suitable legal basis will be ensured.

Recording areas will be appropriately marked where legally required. The marking should clearly indicate the respective controller.

17. Hazards, accidents, first aid and lost property

Hazards, accidents, fires, damage, suspicious objects or other safety-relevant observations must be reported to staff immediately.

In the event of danger, evacuation or other safety-relevant situations, announcements, alarm signals and staff instructions must be followed immediately. Visitors must use the marked exits and escape routes calmly and without delay and must not obstruct rescue and emergency services.

Depending on the type, size and official requirements of the event, suitable first-aid, medical and, where applicable, physician care structures will be provided. Instructions from medical, security and stewarding staff must be followed in the relevant situation.

Lost property must be handed in to staff, at the information desk or another announced point. Lost property will be handled in accordance with statutory provisions and the organizational requirements of Arena Nova BetriebsgmbH.

18. Authorities and official supervision

Official bodies must be granted access to the required areas within the scope of their legal powers and supervisory activities.

Lawful instructions from the competent authorities must be followed. This applies in particular to safety, event, fire safety, health, building, trade and youth protection measures.

19. Liability and compensation

Anyone who culpably damages, soils or destroys facilities, installations, buildings, areas or other property of Arena Nova BetriebsgmbH, the organizer or third parties is liable in accordance with statutory provisions.

For damage caused by minors, the legal representatives are liable in accordance with statutory provisions, in particular in the event of a breach of existing supervisory duties.

Arena Nova BetriebsgmbH is liable only in accordance with statutory provisions. Liability for sport-, event- or use-typical risks is excluded insofar as legally permissible; mandatory statutory liabilities remain unaffected.

20. Violations, removal and ban from the premises

In the event of violations of these House Rules, official requirements, legal provisions or staff instructions, persons may be warned, excluded from entry or removed from the premises.

In the event of serious or repeated violations, endangerment, criminal acts or significant disruption of operations, a temporary or permanent ban from the premises may be imposed.

Persons who enter the premises or rooms of Arena Nova despite an existing ban from the premises may be removed from the premises without entitlement to a refund of the admission price, insofar as legally permissible. Further legal steps, in particular notifying the competent authorities, remain reserved.

21. Final provisions

Should individual provisions of these House Rules be or become invalid, unenforceable or incomplete, the validity of the remaining provisions shall remain unaffected. In place of the affected provision, a legally permissible provision shall apply that comes as close as possible to the purpose of the original provision.

Arena Nova BetriebsgmbH reserves the right to amend these House Rules for objective reasons, in particular in the event of changes to legal, official, safety-related or operational requirements.
